Rep. Trey Wharton introduced HB 4926, a bill on Taxation, to the Texas House on Thursday, March 13 during the 89(R) legislative session, according to the Texas Legislature website.

More specifically, the official text was summarized by the state legislature as ’’relating to authorizing certain counties to impose a hotel occupancy tax and the use of revenue from that tax’’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

This bill allows counties in Texas with populations under 100,000, that border the Navasota River and host an annual renaissance festival, to impose a hotel occupancy tax. The tax, which excludes hotels operated by nonprofit organizations under Section 501(c)(3), can be set up to 7% of the hotel room price, but only up to 2% if the municipality already imposes a similar tax. The revenue generated can be used for constructing and maintaining civic centers for events like rodeos and agricultural expositions, conducting tourism promotions, and supporting historical preservation efforts. The bill takes effect immediately with sufficient legislative approval or, if not, on Sept. 1, 2025.

Trey Wharton, a member of the House Committee on Corrections, proposed another nine bills during the 89(R) legislative session. He is also a member of the House Committee on Insurance.

Wharton graduated from Texas Christian University in 1989 with a BA.

Trey Wharton is currently serving in the Texas State House, representing the state's 12th House district. He replaced previous state representative Kyle Kacal in 2023.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
